February 14: Welcome to my city. It is one of the most beautiful cities in the world. Known for our diversity; around every corner a new surprise; something for everyone; this city by the bay; this is my San Francisco. How do we celebrate Valentine’s Day?

With our annual pillow fight! Whether an alternative to flowers and candy or to vent some frustration or jut some silly mindless fun, the Great San Francisco Valentine’s Day Pillow Fight takes off today at 6:00 p.m. The event takes place at Justin Herman Plaza, in the shadow of the picturesque Ferry Building clock.

This marks the seventh year the feathers will be flying. There is no organizer or person(s) in charge, people just show up armed with pillows. Though no one is really sure how this Valentine ritual started, the less romantic credit a flash mob years ago.

The only losers are the Department of Public Works who are responsible for the post-fight cleanup. 2011′s festivities were a bit messy and a bigger crowd is expected this year. The city has no plans to stop this fun.

Kevin Smith rose to stardom of sorts with his films “Clerks” and “Mallrats” as well as the “Jay and Silent Bob” movies. Now, he’s turned to working in television, as he has created a new show called “Comic Book Men” that airs on AMC. It is a reality show that is set at Jay and Silent Bob’s Secret Stash, which is the comic shop that Smith owns in Red Bank, New Jersey. What’s clear is that the show is nerdier than ever (in a good way) and that Smith is having a good time working on it.

Asked about his take on what’s going on with the new show – Smith had a bad experience with ABC when he tried to make “Clerks: The Animated Series” – Smith was a bit more optimistic. He noted, “Nah, actually I think this is going to work. Now that we’re a little deeper into it, it feels like it might actually pan out. This is AMC, dude! They don’t put you on the air in a whimsy. They gave this show very serious consideration. But I still feel a little like Roy Scheider in ‘Jaws’ – I’ve seen the shark up close and I don’t want to go through that hell again.”

Asked about how AMC was going to help, Smith noted that the cable network was placing the show in a great timeslot. Said Smith, “It’s true. AMC has nuzzled us safe as kittens in the slot right after ‘The Walking Dead’ and right before their talk show ‘Talking Dead.’ That’s our audience! So you will definitely see us promoting the Walking Dead comics in our store and on our show. We know how to kiss ass. We know how to polish the apple. I love Robert Kirkman. If he came to me and said, ‘Give me your firstborn child,’ I would seriously have to think about it. Not only is his show our lead-in, he’s our spiritual godfather. His geekery allowed our geekery to hit the air.”

How to Represent Yourself in a Small Claims Court

Under most state rules in the United States, lawyers are not allowed in a small claims court. However, if you are suing or are being sued by an attorney, then you could request to be represented by a lawyer as well. Nevertheless, in most cases, a small claims settlement is done directly in front of a magistrate without lawyers present. This is not such a big deal and you can make the most of self-representation by being prepared and honestly putting forth your own case.

What is a Small Claims Court

The “Small Claims Court” is a part of a state’s court system that typically hears civil cases between private litigants, where the claimant tries to resolve a monetary dispute where the amount of money does not exceed $ 5000 (this limit may slightly vary from state to state). The aim of such a court is to provide an inexpensive and quick platform to resolve small claims without the litigants having to go through any complex legal procedures and without engaging the services of lawyers.

General List of Claims Filed in a Small Claims Court

Given below is a list of typical claims filed in a small claims court. Remember that the money limit condition remains the sole criteria for a claim (and counterclaim as well) to qualify for settlement in a small claims court. The nature of the complaint or its urgency do not matter!

Claim to refund of money made as down payment, back rent or security deposit
Claim on dud checks
Claim for payment of wages, contract dispute for labor
Claim on damages or refund on faulty workmanship or defective merchandise
Claim on damages to property due to an accident

You cannot file a complaint with a small claims court for claims arising from alimony support, professional malpractice, domestic or marital disputes, libel or slander, damage to your reputation (defamation charges) or claims valued above the money limit of a small claims section.

An important thing to remember is that if you are suing in a small claims court to save time, but are actually entitled to damages exceeding the money limit of the court, you’re effectively forfeiting your claim on the remaining amount. In case you decide to go ahead with a small claims settlement on the partial amount, you cannot claim the remaining money in a separate lawsuit!

Representing Yourself in a Small Claims Court

Preparing to File a Complaint

The complainant must be 18 years of age or older. If not, the parent or guardian may file the actual complaint.
Be aware of the statute of limitation that defines how long you have to start a case (depends on the type of case).
The Office of the Special Civil Part of the county where the case is filed must be the residence or office/business location of at least one of the defendants.
You may even file the case for claims online (available in most states). This is usually possible for a fixed amount of money. The defendant receives the printed court order on the same day of filing! Check if this works for your case.
For an in-court settlement, if you’re the plaintiff, ensure to fill the complaint form properly. Fill in your own address, the defendant’s address, telephone numbers, claim amount and all the other details correctly so as to ensure proper service of your complaint.
Sign the form and pay the correct fees for filing. The clerk/staff of the Special Civil Part can be consulted for these procedures.
The cost of filing a complaint may differ from state to state. If you cannot afford the cost, you may apply to the court to grant you a waiver by qualifying you as an indigent.
Trace out all the records that would support your claim or counterclaim such as canceled checks, bills, contracts, photographs, etc. If you need the support of witnesses, ensure they are ready and available to testify. Be ready with all the paperwork and evidence.
If you need legal advice or knowledge about state statutes, ensure to consult an attorney at the earliest about arguments that could prove your claim.

If you’re jittery about court procedures and nervous about standing before a magistrate, ensure that you follow the above tips in preparation for court. Doing your homework thoroughly will do wonders to your confidence levels whether you’re suing or being sued.

Small Claims Court Proceedings

You will be notified (through a notice of allocation) about the time and place of the hearing. In fact, you might be asked to deal with the claim without a hearing. A lack of reply will be treated as the need for a preliminary hearing where the magistrate might explain or give personal directions to the concerned parties. Subsequently, a final hearing may take place. The following information will be useful in knowing how to represent yourself in a small claims court.

Dress appropriately, in a professional manner and follow basic courtroom etiquette. Arrive on time.
The staff at the Office of the Special Civil Part will be more than ready to answer any questions that you may have before the hearing. However, that does not substitute legal advice; take them as recommendations or suggestions only.
You may even find an information booklet when you go to pick up your claim form.
If you’re the defendant and fail to show up, the default ruling may be against you and you may be directed by the court to settle the claim to the plaintiff.
When providing a list of documents to support your case, present it neatly, in a chronological order.
Don’t worry, you don’t have to sound or act like a lawyer. You will find the proceedings in a small claims court rather informal and not as strict regarding rules of evidence. Mostly, just follow the directions of the magistrate and you should be fine.
If you’re not comfortable speaking English, you can have your interpreter speak on your behalf (notify the magistrate in advance) but the court does not usually provide an interpreter.
You will most likely be assigned a time limit in which the hearing needs to be completed, so ensure that you’re making the most of the time allotted.
The magistrate may appoint a mediator to help settle your case.
If you win the case, the Judgment Collection Brochure will have information about how to collect your judgment (including court costs). However, the court does not force the defendant to settle the claim immediately! If the claim is not settled voluntarily according to the judgment, you will have to take additional steps to recover the claim. Consult the clerk of court for the exact procedure for judgment debtor exam, garnishment of wages, etc.
If the final ruling is not in your favor, as the plaintiff or defendant you may appeal against the ruling; you will not get back the court fees. The procedure varies from state to state. Appeals are generally accepted only if there have been serious irregularities in the proceedings.

Self-representation in a small claims court is not a big deal from the legal proceedings perspective. As a claimant, you might find it to be a quick and hassle-free process if the defendant is willing to co-operate on some level (such as agreeing to mediation or final judgment, etc.). For small claims, it does not make sense for a claimant or defendants to appoint a lawyer and start a full-fledged legal proceeding. However, a small claims suit should not be the first resort. Ensure that as a claimant you have asked for the claim out of court. If you’re the defendant, and if you feel the claimant has every right to the claimed amount, it is best to avoid a hearing and pay up. It is best to resolve disputes without litigating. In case you do choose the small claims court as your next step, the above tips will hopefully help you win your claim.

Siri Support for Mandarin Chinese, Japanese, and Russian Languages Coming Next Month?

Tech in Asia reports on an article [Google translation] from Chinese information technology website DoNews claiming that Apple is preparing to bring support for the Chinese language to Siri on the iPhone 4S next month. According to the report, Apple is also preparing to launch support for Japanese and Russian, but the initial Chinese support will only include Mandarin, with Cantonese and other dialects being left out for the time being.

The Chinese tech site DoNews claims to have heard from an Apple engineer who’s working on the Chinese-language version of Siri, the clever voice assistant on the iPhone 4S. From this source it claims that Siri will launch in Chinese next month, and is already undergoing internal testing this month. [...]

The rumor also contends that the Chinese version will only support the standard Mandarin (aka: putonghua) Chinese, which would leave out Cantonese-speaking people, as well as some Taiwan folk who effectively speak in a different dialect. Plus, it alleges that Japanese and Russian will arrive next month as well.

Siri currently supports only English (United States, United Kingdom and Australia), French, and German but in Apple’s Siri FAQ the company promise support for additional languages, including Japanese, Chinese, Korean, Italian, and Spanish, this year.

Chinese support for Siri is likely a high priority for Apple, given the strong growth the company is experiencing in the country. The iPhone 4S launched on partner carrier China Unicom last month and rumors are swirling that it may debut on China Telecom in the very near future.

Japan is another key market for Apple, with the company having enjoyed long-standing popularity with users and where the iPhone 4S debuted as part of the first round of launches in mid-October. Apple has placed less emphasis on Russia, but along with Brazil, India, and China the country is considered to have one of the world’s up-and-coming economies where Apple would certainly like gain momentum. The iPhone 4S launched there in mid-December.

Did you know that a fetus develops its first sensitivity to touch by eight weeks of gestational age? By fifteen weeks, a human fetus has an adult’s taste buds and may even begin to savor the taste of the amniotic fluid! It is no wonder then that even the most ancient wisdom prods a mother-to-be to be careful about her health and maintain a relaxed and peaceful state of mind at all times. By 25 weeks of gestational age, your baby is able to hear your voice and perhaps your partner’s (if the sound is close enough to the womb) and by 27 weeks, the baby is even known to recognize the mother’s voice. Yes, mind your language around your womb!

Fun Activities to Induce Your Baby’s Senses
On a more serious note, here are some practical ways in which you can make use of the above knowledge and begin to stimulate your baby’s developing senses of hearing, smell, sight, touch and taste. You can start your interactions with your child and begin the first lessons in life while it’s still in the womb! Of course, once the baby is born, you can take over from where you left off the womb lessons and continue stimulating the senses further, especially its sense of sight (which develops the most after the baby is born in the first few weeks). Let us explore some fun ways to stimulate your baby’s senses.

	Prenatal Stimulation	Stimulation After Birth
Sense of Touch	Stroking the pregnant belly is a common form of stimulation. It comes naturally to the mother from early pregnancy. In response to the kicking and nudging felt inside the womb, you may even try to gently massage the belly using coconut oil or olive oil. Experts suggest that gently caressing your pregnant belly regularly and patting it in a rhythmic fashion, especially before bedtime can have a soothing effect on the baby. In fact, the baby will continue to associate these touching and calming activities with sleep time even after birth, making it easier for you to put the baby to sleep. Encourage your partner and even your other children to engage in this most basic form of interacting with the baby through stroking of your belly. There’s a great likelihood of the baby remembering these interactions even after birth.	Make your newborn baby feel safe and secure by gently caressing the face and limbs. About two months after birth, you may start massages with some pressure and in a kneading motion. Bath time can provide great moments to introduce your baby to the world of cold water, warm water, water droplets and foam, etc. Rubbing the muscles on the limbs helps develop your baby’s body language. Expose your baby to different textures using creams, oils, paper, cloth, sprays, soap bubbles, etc. Let your baby feel these substances with bare hands and explore his/her sense of touch! Gradually, let your baby play with toys and objects of different shapes and textures. Just leave soft-edged toys or empty, colorful cardboard or plastic boxes with the baby on an activity mat and watch the fun. Don’t prod too much except when objects start moving towards their mouths!

Sense of Hearing	Sound stimulation is the easiest form of fetal stimulation, even though the baby’s ears are filled with amniotic fluid inside the womb. The baby constantly hears the mother’s heartbeat, her digestive gurgling and blood whooshing through her body. So go ahead and talk to your baby. The mother’s voice is known to be very soothing to the baby. You may indulge in reading stories aloud and even singing to your baby. Do not talk around the baby but to the baby (the hearing is not that well-developed yet). Silly as it may seem, stroke your belly while reading and talking to your baby in the womb. Even the deeper voice of a father may be audible to the baby if it is close enough to the belly. Low sound frequencies are known to travel through liquids. Go ahead and play the low notes on the piano or the bass and percussion instruments. If your baby is awake and active, you may witness jigging responses to the music. The mother’s heartbeat is perhaps the most rhythmic and familiar sound recognized by a fetus. You might want to turn the music down if you feel rapid, disorderly movements from your womb. High-pitched sounds and noise are not positive stimulations.	Again, in conformance with ancient wisdom, lullabies and soft, comforting voices of its parents are a baby’s favorite sounds. Indulging in a sleep time routine of soft music and rhythmic rocking usually puts most babies to sleep. Till about five months after birth, the baby is not aware of the source of the sound. After that, you will notice that your baby instantly turns towards the source of sound and tries to “face” the music! Encourage this behavior and try to indicate to the baby what object is making the sound. Imitating the sounds of animals is mostly a sure shot way of making a baby smile or laugh. They love repetitive and funny noises. There’s a reason why a noisy rattle is a baby’s best friend. It engages the baby’s senses of touch and sound and the baby knows the source of the sound. By learning to play the rattle or even objects like spoons, etc., the baby tries to control the source of sound and discovers that he/she can actually make the sound and stop it too! It is a small achievement but a big developmental milestone for the little one. Use bath time to let your baby discover the various sounds of water (pouring, splashing, squirting, etc.).

Sense of Smell and Taste	Inside the uterus, the nose of the fetus develops by the fifteenth week of gestation. The amniotic fluid that fills the nasal cavities and mouth of the fetus is believed to be its first tryst with odors and taste. Maintaining a healthy diet and incorporating many flavors is perhaps the only stimulation you can provide. In fact, pregnancy cravings could be your baby’s way of telling you what it likes! Irrespective of conscious stimulation; however, the sense of smell is strongest at birth. The fetus is shown to swallow more amniotic fluid when it has a sweeter taste than when it’s bitter or sour. This seems to be in preparation to instinctively seek out and savor breast milk as soon as it is born. Sounds like your baby can have a sweet tooth even before its teeth start to emerge!	Your baby might just love your regular perfume. Anything that constitutes a mother’s scent is stimulating for the baby. Let your baby be carried around by other members of your family. This will help expose them to scents other than the mother’s. Yet again, bath time is the best opportunity to expose your baby to other pleasant smells. The scents of soap, shampoos and fresh towels can be a fun experience. Keep your baby away from the strong smells of smoke and burning. Not only will these smells seem obnoxious and uncomfortable for the baby, prolonged exposure will affect the baby’s sense of smell. Chewy toys in different flavors make babies salivate helping them to explore different tastes. Do not bombard your baby with the taste of flavors, gradually move from bland to intense flavors of mashed vegetables and fruits in the daily diet. Don’t overdo the use of spices and condiments. When the baby has developed its teeth, include food with different textures (soft, grainy, sticky, watery, etc.). With these stimulation methods, your baby will slowly learn to associate colors, flavors, odors and consistencies, thus putting into use all the senses at once.

Sense of Sight	The sense of sight is the last to develop; the eyelids remain closed until twenty six weeks of gestational age. Subsequently, until birth the eyes open and the blinking reflex develops. Want to show a flashlight towards your pregnant belly? Experts suggest it could harm your baby. Refrain from doing so until the last month of pregnancy and do it only when you’re absolutely sure the baby is active and not asleep. It is recommended not to show very intensely bright light. You may attempt to time this activity to tune the sleep cycle. Sometimes it works, when the baby is awake as long as the light shows and dozes off soon after the light is turned away. You will notice the responses and most mothers are able to tell if this technique works for them. Be careful not to expose your belly to bright lights for a prolonged period, it might result in retinal damage to the fetus! You might witness some strong reactions to momentary disappearances of mothers and favorite toys. Wish to intrigue your baby some more? Bring out the photo album or play a photo slide show on your laptop. Guess which faces the baby is sure to recognize and observe the hilarious and adorable responses. Now that’s a natural stress buster! Colorful stacking blocks and hoops, toys that move back and forth and bob about the floor are all objects that fully engage the vision of a baby.

Why is there so much stress on stimulating a baby’s senses, now even extending the concept to the womb? Isn’t that taking things a bit too far? Well, a lot depends on your perspective of whether you want to educate your child just a few weeks into conception or soon after birth.
